Does Subclass 494 Grant Permanent Residency?

The Skilled Employer Sponsored Regional (Provisional) visa (Subclass 494) is a 5-year provisional visa. It does not grant permanent residency immediately. Eligible 494 visa holders may later apply for Permanent Residence (Skilled Regional) visa (Subclass 191) after meeting the required conditions.

Criteria for Employers (Subclass 494)

To nominate a worker under Subclass 494 (Employer Sponsored stream), the employer generally must:

  • Be located in a designated regional area (as defined by the Department’s regional categories/postcodes)
  • Obtain RCB (Regional Certifying Body) advice for the nominated position (process varies by state/region)
  • Nominate an occupation on the relevant 494 eligible lists (MLTSSL or ROL, depending on the occupation)
  • Offer a genuine, full-time position with employment conditions consistent with Australian standards
  • Pay at least the Annual Market Salary Rate (AMSR) for the occupation

Yes. The Skilled Employer Sponsored Regional (Provisional) visa (Subclass 494) is a 5-year provisional visa that provides a clear pathway to permanent residency through the Permanent Residence (Skilled Regional) visa (Subclass 191).

Pathway from Subclass 494 to Subclass 191 (PR)

To be eligible for the Subclass 191 visa, the primary applicant must generally:

  • Have lived, worked, or studied in designated regional Australia for at least 3 years
  • Have held an eligible regional provisional visa (such as Subclass 494) during that period
  • Have met the minimum taxable income threshold for at least 3 income years
    (income is assessed individually, based on ATO records)
  • Have complied with visa conditions, including regional residence requirements

Important Clarifications  

  • Only ONE applicant needs to meet the income requirement (the primary applicant)
  • Both partners do NOT need to meet the income threshold
  • Either partner can apply as the primary applicant for Subclass 191
  • Family members included in the 494 visa can also be included in the 191 PR application
  • Income is not combined between partners for eligibility
