The Partner (Provisional and Migrant visa) (subclass 309 and 100) grants residency to those who are married to or in a de facto relationship with an Australian citizen, a permanent resident, or an eligible New Zealand citizen.

Initially, the applicant receives the provisional 309 visa, which is temporary and valid for two years. Within this time, the applicant can apply for the permanent migrant 100 visa, granting long-term residency in Australia.

Qualification Criteria

For Partner (Provisional) Visa (Subclass 309)

  • You are required to be outside Australia during both the application submission and the decision.
  • You must be legally married or in a de facto relationship with an Australian citizen, a permanent resident, or an eligible New Zealand citizen.
  • Applicants must be at least 18 years old when they apply for the visa.
  • If your partner is younger than 18, a sponsor is required who is an Australian citizen, permanent resident, or eligible New Zealand citizen and can be a parent or guardian of your partner.
  • You need to fulfill health and character requirements set by the government.
  • All your debts to the Australian government must be paid off before your visa is issued.

For Partner (Migrant) Visa (Subclass 100)

  • You must be a holder of a temporary partner visa (subclass 309).
  • Your marriage or de facto relationship must continue unless there are exceptional circumstances.
  • You must adhere to all the Australian laws and the specific conditions of your temporary 309 visa.

 

Health and Character Requirements

All applicants and their family members included in the visa application are required to:

  • Undergo medical examinations within one year before applying for the visa
  • Secure police certificates from each country lived in for at least 12 months in the past decade

 

Sponsor Obligations

Sponsors must ensure the following provisions are met for two years after the applicant’s entry into Australia with a temporary migrant 309 visa:

  • Provision of housing
  • Economic support, including funding for English language courses if needed
  • Additional necessary support such as child care, if required
