The Remaining Relative 115 visa offers permanent residency to those who are the sole remaining members of their family in their home country, with all immediate family members permanently residing in Australia.

If you have the Remaining Relative visa, you can:

  • Settle in Australia as a permanent resident
  • Apply for citizenship in Australia once eligibility criteria are met
  • Leave and re-enter Australia freely for five years from the visa issuance date (you must obtain a new visa to return after five years)

 

Visa Eligibility Criteria

This visa requires that you:

  • and your partner’s close family members are Australian citizens, Australian permanent residents, or eligible New Zealand citizens, and they reside in Australia
  • have a qualifying near relative or their spouse (minimum age 18) who agrees to sponsor you and your family members
  • obtain a commitment of support from someone (a legally binding promise to provide financial support)
  • you and your dependent family members meet the mandatory health and character standards

Criteria Disqualifying You From This Visa:

  • If you or your partner’s immediate family members are without lawful status, hold a bridging visa, or any temporary visa.
  • If your sponsor or their partner was a holder or sponsor of a Remaining Relative visa (subclass 835 or 115), Preferential Family visa (subclass 104), or Family Visa (subclass 806).

 

Who Qualifies as a Near Relative?

A near relative residing in Australia must be one of the following:

  • Parent or step-parent, whether yours or your partner’s
  • Biological sibling or stepsibling
  • Brother or sister through marriage (stepbrother or stepsister)
  • An adult child or stepchild who is 18 or older and independent
  • A child or stepchild under 18 not under your or your partner’s direct care

 

Health & Character Requirements

All applicants and their dependents listed in the visa application need to:

  • Pass a health check by completing the necessary medical examination
  • Get police clearance certificates from each country where you and your family members aged 18 or older have lived for more than 12 months in the past ten years

 

Australian Government Debts

Before your visa can be issued, you must settle any unpaid debts to the Australian Government.
