Remaining Relative Visa (Subclass 115)

The Remaining Relative 115 visa is a permanent residency visa for individuals who are the last remaining members of their family in their home country, while all their close relatives have moved to Australia.

Applicants must be outside of Australia (offshore) both at the time they apply for the visa and when it is granted.

Advantages of Holding the 115 Visa

As a holder of the Remaining Relative visa, you are entitled to:

  • Reside permanently in Australia
  • Seek Australian citizenship, provided you meet the necessary requirements
  • Travel out of and return to Australia multiple times for five years after your visa is issued (after five years, you will need a new visa to come back to Australia)

 

Qualification Requirements

To be eligible for this visa, you must:

  • have near relatives residing in Australia who are Australian citizens, Australian permanent residents, and/or eligible New Zealand citizens
  • have an eligible near relative or their spouse (who must be at least 18 years old) willing to sponsor you and all your family members
  • have an individual willing to provide an assurance of support (a formal commitment to provide financial backing)
  • ensure that you and your dependent family members satisfy the health and character requirements

Ineligibility Criteria for This Visa:

  • You or your partner’s close relatives are in an unlawful status, possess a bridging visa, or any other form of temporary visa.
  • Your sponsor, or their partner, previously held or sponsored someone under the Remaining Relative visa (subclass 835 or 115), Preferential Family visa (subclass 104), or Family Visa (subclass 806).

 

Eligible Near Relatives Definition

In Australia, a near relative can be any of the following:

  • Your parent or your partner’s parent, including biological and step-parents
  • Your sibling or your partner’s sibling
  • Your stepbrother or stepsister
  • Your child or stepchild who is 18 or older and not financially dependent on you
  • Your child or stepchild under 18 years old who does not live under your or your partner’s care

 

Health & Character Requirements

Applicants and their dependent family members included in the visa application must:

  • Undergo a health examination and satisfy the basic medical standards required
  • Secure a police verification certificate from every country where you and your adult family members have resided for over a year during the last decade (Applicable only to those 18 years and older)

 

Outstanding Debts to the Australian Government

You need to clear all your existing debts to the Australian Government before your visa can be approved.
